Globonex Commercial IT Services Provider
Effective Date: September 01, 2026 Governing Jurisdiction: Courts of Pakistan

1. Electronic Formation of Contract

These Terms and Conditions ("Agreement") constitute a legally binding electronic contract between Globonex ("Company", "Provider", "we", "us") and the individual or legal corporate entity ("Client", "Subscriber", "You") registered on this portal.

In accordance with Sections 3, 6, 7, and 8 of the Electronic Transactions Ordinance, 2002 (Ordinance LI of 2002), your electronic assentβ€”expressed by ticking terms acceptance, creating a client account, submitting digital order forms, or remitting invoice paymentsβ€”holds full legal force, validity, and evidentiary admissibility equivalent to a physical handwritten contract under Pakistani law.

2. Provision of Cloud & IT Services

Provider agrees to deliver web hosting services, domain name registration management, cloud computing packages, and proprietary software licenses as configured on our storefront subject to the conditions of this Agreement:

  • Web & Cloud Hosting: Provisioning of disk storage, compute capacity, cPanel/direct management consoles, and network bandwidth on dedicated or shared infrastructure.
  • Domain Management: Acting as an authorized registering agent for PKNIC (.pk) and ICANN-accredited registries. All domain registrations remain subject to registry availability and third-party registry policies.
  • Software Applications & Digital Products: Delivery of digital binaries, web application source code, and unique cryptographic license keys for software packages developed or distributed by Provider.

3. Acceptable Use Policy (AUP) & Cybercrime Prohibition

The Client explicitly covenants not to utilize Provider's infrastructure, servers, or mail relays for any activity declared unlawful under the Prevention of Electronic Crimes Act, 2016 (PECA 2016), the Pakistan Penal Code (PPC), or regulations of the Pakistan Telecommunication Authority (PTA). Prohibited actions include:

  • Malicious Activities: Spreading trojans, viruses, rootkits, ransomware, botnets, or executing distributed denial of service (DDoS) attacks (PECA 2016, Sec. 3, 4, 10).
  • Phishing & Electronic Fraud: Operating unauthorized spoofed banking pages, scam storefronts, or deceptive phishing sites (PECA 2016, Sec. 13 & 14).
  • Unsolicited Commercial Email (Spam): Transmitting bulk unsolicited email or spam through server IP pools (PECA 2016, Sec. 25).
  • Copyright Infringement: Hosting pirated software, unlicensed multimedia content, or warez portals in violation of the Copyright Ordinance, 1962.
  • National Security & Defamatory Content: Hosting content detrimental to the sovereignty, integrity, or defense of Pakistan, or defamatory content prohibited by applicable laws.
⚠️ Zero Tolerance Notice: Any verified violation of the Acceptable Use Policy will result in immediate service suspension or termination without notice and without eligibility for any refund. We reserve the right to report severe cybercrimes to the FIA Cyber Crime Wing.

4. Software Intellectual Property & Licensing

All proprietary software products (such as Hotel Management Systems, POS Suites, Billing Automation modules, scripts, and digital assets) created by Globonex are protected under the Copyright Ordinance, 1962 and intellectual property laws of Pakistan:

  1. License Grant: Upon payment of the prescribed license fee, Provider grants Client a limited, non-exclusive, non-transferable, revocable license to utilize the software within the authorized number of installations or domain references.
  2. Restrictions: Client shall not decompile, reverse-engineer, disassemble, modify, resell, sublicense, or distribute license keys or compiled source files without prior written authorization from the Provider.
  3. License Revocation: Unauthorized redistribution, cracking, or concurrent use beyond licensed seats will result in immediate cryptographic blacklisting of the license key and potential civil damages.

5. Billing, Invoicing & Service Lifecycle

Services are pre-billed according to the chosen billing cycle (Monthly, Quarterly, Annually). All invoices are denominated in Pakistan Rupees (PKR) or USD where explicitly offered.

  • Payment Due Date: Invoices are generated with a standard 14-day payment settlement grace window from the issue date.
  • Overdue Service Suspension: Hosting accounts remaining unpaid past their due date are subject to automated automated service suspension until all outstanding balances are settled.
  • Account Termination: Suspended services remaining unpaid for over 30 days are subject to permanent termination and data purge from primary server storage. Client acknowledges sole responsibility for keeping backups.

6. Service Level, Backups & Limitation of Liability

Provider strives to maintain a 99.9% network and infrastructure availability uptime. However, to the maximum extent permitted by Pakistani law:

  • No Indirect Damages: Under no circumstances shall Provider be liable for any lost revenue, loss of business profits, indirect, punitive, or consequential damages resulting from downtime, scheduled maintenance, or third-party telecommunication disruptions.
  • Backup Responsibility: While automated server snapshots may be taken for disaster recovery, Client is solely responsible for maintaining local off-site copies of critical database tables, web files, and emails.
  • Liability Cap: Provider's maximum aggregate financial liability under this Agreement shall not exceed the actual fees paid by Client to Provider for the specific affected service during the thirty (30) days preceding the claim.

7. Governing Law & Dispute Resolution

This Agreement shall be governed by, construed, and enforced in accordance with the Substantive Laws of the Islamic Republic of Pakistan. Any controversy, dispute, or legal proceeding arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the competent courts having territorial jurisdiction in Islamabad, Pakistan.
